“President Trump’s self-described “takeover” of the Kennedy Center is another salvo in his demonstrated attack on free expression. He is taking the unprecedented move of clearing out board members “who do not share our vision for a Golden Age in Arts and Culture.” Presidents should not be dictating a singular view of culture. The cultural sector must remain free from political control; that is fundamental to protecting creative freedom in a democracy.”

"More than a dozen new state and local policies contributed to the escalation of book bans over the past year. They include Iowa’s SF 496,which took effect last year and has been interpreted to mean that books with sexual or gender themes should be barred. According to PEN America, the law prompted thousands of book bans during the 2023-’24 school year, compared with just 14 bans in the state during the previous school year. 

Florida’s HB 1069, which also took effect last year, mandates that books challenged for “sexual conduct” must be removed as they undergo review. PEN America said the statutory process the law created for book banning and “the state guidance building on it” has led to a spike in statewide book bans. In Florida and Iowa combined, roughly 8,000 book bans were recorded. 

In Wisconsin, the Elkhorn Area School District banned more than 300 books for months on end, PEN America found. The books were removed after a single parent challenged them, but after the district reviewed the titles, they were eventually returned to the shelves, albeit with restrictions such as parental permission to check out certain titles. The organization expects newly enacted laws such as Utah’s HB 29, South Carolina’s Regulation 43-170 and Tennessee’s HB 843 to cause more book bans this school year. 

The Utah law requires all schools in the state to ban a book once three school districts have found it objectionable. South Carolina’s regulation bans books with sexual subject matter and gives the state Board of Education the ability to censor works statewide. The Tennessee law requires schools to remove books with gratuitous violence or sexual content...

Censorship is an issue that has drawn attention from the 2024 presidential candidates. Former President Donald Trump’s campaign platform accusesPresident Joe Biden’s administration of “using the public school system to push their perverse sexual, racial and political material on our youth.” In July, Vice President Kamala Harris, the Democratic nominee, criticized book bans while speaking to the American Federation of Teachers union in Texas.  

“While you teach students about our nation’s past, these extremists attack the freedom to learn and acknowledge our nation’s true and full history,” she said. “We want to ban assault weapons, and they want to ban books. Can you imagine?”

"In the 2022-2023 school year, Florida led the nation in the surge of book challenges and bans, according to free expression advocacy group PEN America. This year, the number of bans has more than doubled.

Research by the nonprofit organization found more than 10,000 instances of book bans across the country, with 8,000 of them from Florida and Iowa, according to preliminary findings released Monday at the start of Banned Books Week. This was largely due to new state laws, PEN America's Kasey Meehan and Sabrina Baêta said.

Florida's HB 1069, which went into effect July 2023, required that any book challenged for "sexual conduct" must be removed during the review process and empowered parents and guardians to challenge books without providing ways for parents or guardians to defend them. That led to a "significant rise in book bans" during the 2023-2024 school year, PEN America said."

"In a statement issued Wednesday, Scholastic said it will keep in mind the needs of the children it serves as well as educators facing local content restrictions. 

"It is unsettling that the current divisive landscape in the U.S. is creating an environment that could deny any child access to books, or that teachers could be penalized for creating access to all stories for their students," it wrote.

PEN America, the nonprofit organization that supports free speech, acknowledged Scholastic's dilemma and applauded its decision to pivot. 

"Scholastic recognized that, as difficult a bind as this pernicious legislation created, the right answer was not to become an accessory to censorship," Jonathan Friedman, the director of its Free Expression and Education program, said in a statement. "Scholastic is an essential source of knowledge and a delight for countless children. We are glad to see them champion the freedom to read.""

"More than two years into a sharp rise in book challenges across the United States, restrictions are increasingly targeting public libraries, where they could affect not only the children’s section but also the books available to everyone in a community.

The shift comes amid a dramatic increase in efforts to remove books from libraries, according to a pair of new reports released this week from the American Library Association and PEN America, a free speech organization.

The A.L.A. found that nearly half the book challenges it tracked between January and August of this year took place in public libraries, up from 16 percent during the same period the year before. The association reported nearly 700 attempts to censor library materials, which targeted more than 1,900 individual titles — more than during the same period in 2022, a year that saw the most titles challenged since the organization began tracking the data.

Most of the challenged books were by or about people of color or L.G.B.T.Q. people.

“A year, a year and a half ago, we were told that these books didn’t belong in school libraries, and if people wanted to read them, they could go to a public library,” said Deborah Caldwell-Stone, the director of the A.L.A.’s Office for Intellectual Freedom. “Now, we’re seeing those same groups come to public libraries and come after the same books, essentially depriving everyone of the ability to make the choice to read them.”"

"A recent PEN America study found that the bans were most prevalent this year in Florida, Texas, Utah, Missouri and South Carolina.

Consistently, these bans target materials written by and about people of color or LGBTQ+ individuals, and even though a 2022 poll found that 70% of parents oppose them, they are continuing at a rapid rate.

Now the Digital Public Library of America (DPLA) is trying to fight back. It recently launched the Banned Book Program, granting free nationwide access to books restricted in schools or libraries.

It functions through GPS-based geo-targeting; by typing in your zip code, you are shown the complete list of titles prohibited in your area. Once you download the Palace e-reader app, these books are available to download.

“Saying ‘Just to go to the library’ is no longer a stable alternative to having these books in schools,” Jen said. “Some kids don’t have supportive parents or live near public transport. The DPLA has created a resource that will benefit so many.”"

"House Bill 900 goes into effect on Sept. 1. This law regulates and establishes new standards for reading material at public school libraries. Book vendors will assign ratings to books based on sexual references. Depending on the level of the rating, a child might need parental consent to check out the book, or the book could be banned and removed from the bookshelves.

Kasey Meehan is PEN America Freedom to Read Program Director.

“An effort to really suppress free speech,” Meehan said.

PEN America is a national non-profit organization that defends and celebrates free expression through literature.

“So, one of the, you know, pieces of rhetoric that we’re constantly pushing up against this idea that there’s obscene material in schools or pornography in schools, and by no definition of those terms is that the case. These books are intended to be in schools.” Meehan said. “Sometimes it can be individuals in the district, in the school district, or in the community that are challenging books. And increasingly, though, we also see the role of legislation influencing what books are available.”

"At least 238 writers, academics and intellectuals around the world were detained in connection to their work last year, according to a report released Tuesday by PEN America, a freedom of expression advocacy group.

The imprisonments and detentions occurred in 34 countries, although the majority took place in just three — China, Saudi Arabia and Turkey. Those same countries are also among the top jailers of journalists worldwide, according to the 2019 Committee to Protect Journalists prison census.

The data published Tuesday as part of PEN America’s inaugural Freedom to Write Index accounts for poets, scholars, songwriters and translators, among other intellectuals the group described as unjustly detained last year around the world. It does not include journalists unless they also belong to one of the categories in question. Some detained individuals were excluded from the report at the request of family members who feared that public attention could worsen their situations."

"Both the NCAC and PEN America say the best response to hate speech is not more censorship.

"Trying to suppress hateful speech doesn't make it go away," says Bertin. "I mean, I think the whole idea of free speech requires us to be active participants, and when we hear ideas that we think are bad and harmful, it requires us to say 'why,' not just say 'shut up.'"

But publisher Dennis Johnson says another equally important right is at stake here: The right to protest.

"On June 27, Mr. Cooper’s Google account was deactivated, he has said. He lost 14 years of his blog archives, creative work, email and contacts. He has hired a lawyer and made complaints, and many of his readers and fans have tried to support his efforts. There is a petition circulating, urging Google to restore his work. Pen America, an organization that promotes free expression, has weighed in, saying that Mr. Cooper deserves a substantive response from Google.

Thus far, these efforts have been in vain. Google has not responded beyond saying there was a violation of the Terms of Service agreement. It has neither identified the specific violation nor indicated why it also deleted Mr. Cooper’s email account. It has not provided Mr. Cooper with the ability to download his personal information so he might rebuild his blog and email account elsewhere. In one interview, Mr. Cooper said he thought that the male escort ads might have led to his account’s being deactivated, but this has not been confirmed by the company.

When I contacted Google for further comment, I got a response that said, “We are aware of this matter, but the specific Terms of Service violations are ones we cannot discuss further due to legal considerations.” I asked about why Mr. Cooper’s Gmail account was also deleted and whether or not he would be able to retrieve the archive of his work, and I was directed to Google’s Terms of Service, Gmail Policy and Blogger Content Policy, which did not offer any useful specifics."
